Jacksonville Resisting Arrest Attorneys

Experienced Resisting Arrest Lawyers Jacksonville FL

There are two primary classifications under the Florida Statutes that cover the resisting arrest: resisting an officer with violence and resisting an officer without violence.

Resisting an officer with violence is a third-degree felony punishable by up to 5 years in the Florida State Prison. While resisting without violence is a first-degree misdemeanor and carries a maximum sentence of one-year in the county jail.

Any resisting charge is typically added to an arrest based upon someone's attitude. The police will attempt to penalize a defendant for giving them a hard time.

In order to prove the crime, the officer must be in "lawful execution of any legal duty." This language is broad and open to many interpretations. A skilled criminal defense attorney can hold the officer to the legal standard and question him regarding what duty was resisted upon.
