Murder is the most serious crime in the Florida Statutes and therefore has the most serious penalties. A homicide is typically filed in one of four degrees; the degree depends on the level of intent. Intent is the element of thought or action that went into the execution or act of the crime.

First-degree murder is a capital offense. In order to obtain a conviction for capital murder, the State must prove the defendant acted with premeditation. First-degree murder may also be the result of what is called felony murder, a felony murder occurs when a victim is killed during the commission of a felony.

Second-degree murder is a life offense. Unlike murder of the first degree, second-degree murder does not require premeditation; it only requires an intent of recklessness, or as defined by Florida Statutes, “any act imminently dangerous to another and evincing a depraved mind regardless of human life.”

Manslaughter is a second-degree felony, which does not require any intent, but often stems from the negligence of a defendant. This can result from a variety of situations and often is used when an imperfect self-defense claim is used.

Aggravated manslaughter of a child is a first-degree felony. This can only result from negligence resulting in the death of someone under the age of 18.
